I have a large dog bed behind the chair and it saved him from falling backward off the chair. A month later we had not heard anything back from Bob’s about the visit and again, on 10/2 my husband reclined and almost fell backwards. I reported it to Bob’s and they sent a technician out on 9/2/21. His feet were pointing to the air and his head was about 3 inches from the ground.
Some time in July 2021 when my husband was reclining the chair there was a loud noise and it almost fell over backwards. My husband works shift work and the chair is used less than daily and for no more than 3hrs when it is used. I purchased a recliner for my husband that was delivered in early Sept 2020. Unfortunately, I too am a victim of the “Goof Proof” protection. “Not noticing a stain or damage on the day it occurred is a common circumstance, especially if the furniture is used by other persons within a household and not exclusively by the warranty holder,” Glover’s complaint says. When customers submit a claim under the Goof Proof warranty, it’s allegedly denied with the reasoning that the damage was not actually accidental but rather caused by misuse.īob’s Discount Furniture routinely denies warranty claims if customers are unable to state the exact date in a 30-day period when the damage occurred, the complaint says. Glover alleges that consumers are misled through the defendant’s warranty sales “because the furniture is poorly made,” meaning the company “can more easily and unfairly attribute any accidental stain or rip to a product defect, when there might be cause for overlap between what caused the damage.” In addition, sales employees can receive bonuses or, conversely, be penalized based on how many warranties they are or are not able to sell. The plaintiff says Guardian Insurance provides “undisclosed incentives or kickbacks” to Bob’s Discount Furniture for every Goof Proof warranty sold.
